We, TVS Motor Company Limited ("we", "us", "our"), are the owners of the mobile application titled TVS Connect ("Application").
We respect the data privacy rights and are committed to protecting the personal information collected on this Application and this privacy policy ("Privacy Policy") sets forth how we use and protect the personal information collected on this Application. If you do not agree with this Privacy Policy, you should stop using the Application.
1. What Qualifies as Personal Information
For the purposes of this Privacy Policy, any information relating to the following shall for the sake of brevity be referred to as "Personal Information".
You- such as your photo, name, email id, address, phone number, blood group, medical information (such as allergies), emergency contacts’ information;
Social media- Google Plus id or, Facebook id if you choose either of these services to log on or register with the Application;
Your Vehicle- vehicle name and make, registration number, engine number, date of sale, the dealer from whom you purchased the TVS vehicle, general status data (such as warning lights, upcoming service schedule, fuel level, battery level, tire pressure), service history and issues relating to the vehicle, vehicle performance data, and such other data about your vehicle;
Ride Data- Travel location, route taken, travel date, time, distance, top speed, average speed, information regarding different modes used during the ride (Eco, power etc.) driver behaviour data such as lean angle, speed and braking habits, and collision information; This information will be collected only if you connect your Vehicle with the device in which the Application is installed using Bluetooth, and your device receives global positioning satellite (GPS) signals.
Location Data- this is used by the application to provide user specific information and functionalities. For example - to provide the user with turn by turn navigation feature on the connected vehicles speedometer the app requires to use the location data in background so that even when the users phone is locked and in his pocket the navigation feature in the app continues to work and send turn by turn instructions to the Bluetooth connected speedometer on the bike
Information about devices used to interact with us- such as data gathered by the Application when it is used (such as IP address, GPS location browser information, device type, app and OS version, etc.), demographic information and product preferences and also information relating to the hardware device used on your vehicle which interacts with the application such as its make, model and its GPS location;
2. What Personal/ Non-Personal Information do we Collect?
The Personal Information listed above is collected
(a) directly from you when you purchase the TVS vehicle
(b) directly from you when you sign up for the Application,
(c) through the Application when you download it and also when the Application is used. The Application auto - connects and collects ride information when it is in the background. You can disable auto-connect from the settings of the Application.
Accuracy of information. Please make sure that any Personal Information you share with us is accurate and up to date information. Incorrect information provided to us may have serious consequences and we shall not be responsible for any such consequences.
3. What do we do with Your Personal Information?
We use the Personal Information for the following purposes:
3.1. to authenticate your account or information on our Application;
3.2. to provide you with our services under the Application (including but not limited to road- side assist, provide you ride information, assistance in case of accidents, provide servicing history);
3.3. to generate and provide analytics relating to use of the TVS vehicle and/ or the Application;
3.4. for creation or development of business intelligence or data analytics in relation to our Application;
3.5. to improve usability of the Application and its maintenance;
3.6. to prevent fraud and abuse;
3.7. to enhance the security of the Application;
3.8. to ensure that content from the Application is presented in the most effective manner for you;
3.9. to provide you information that we may believe may be of your interest;
3.10. for internal record keeping; and
3.11. to comply with our legal or statutory obligations.
4. Whom do we Disclose Your Data to?
We do not sell, rent, share, distribute, lease or otherwise provide your Personal Information to third parties, without your prior written consent. Keeping this in mind, we may disclose your Personal Information in the following cases:
4.1. Third Party Service Providers: We use third parties to provide you certain services, to assist us in developing and maintaining the Application, and to enable use of certain features of the Application. For example, we share your location information with services such as Map My India/ Map Box; for determining whether you have had an accident, we use services such as Firebase Analytics and Firebase Fabric.
4.2. Merger or Acquisition: We may transfer your Personal Information if we are acquired by another entity, or if we merge with another company or transfer a part of our business, including the license to this Application, to a third party. Any such third party or resultant entity that receives your Personal Information shall have the right to continue to use your Personal Information in line with the purposes set out herein.
4.3. Legal and Regulatory Authorities: We may disclose your Personal Information in order to comply with our legal obligations/ court orders/ requests by Government authorities.
5 How Long do we Retain Your Personal Information?
5.1. We endeavour to only collect such Personal Information that is necessary for the purposes indicated here, and to retain such data for no longer than is necessary for such purposes. The length of time Personal Information is retained, and criteria for determining that time, are dependent on the nature of the Personal Information and the purpose for which it was provided/ collected.
5.2. Subject to this section, we retain your Personal Information unless you revoke our access or delete your account i.e. if you wish for us to delete your Personal Information in our records, you may contact our support team and request them to have your account with us deleted. Please note, however, that there might be latency in deleting Personal Information from our servers and backed-up versions might exist even after deletion.
6. Our Security Measures
We store your Personal Information in India and this information is accessible to our personnel across our offices. We also implement a variety of security measures to maintain the safety of your Personal Information such as transmission of Personal Information. Although we provide appropriate firewalls and protections, we cannot warrant the security of any Personal Information transmitted as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we assume no liability or responsibility for it.
7. Limitation of Liability
To the extent permissible under the law, we shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, information, or other intangible losses (even if we have been advised of the possibility of such damages), arising out of this Privacy Policy on your use of the Application.
8. Governing Laws and Disputes
This Privacy Policy shall be construed and governed by the laws of India without regard to principles of conflict of laws. Any dispute arising, between you and us shall be submitted to the arbitration to be conducted in Bangalore, India in English language, in accordance with the provisions of Arbitration and Conciliation Act, 1996 as amended from time to time, by a sole arbitrator appointed by Chairman and Managing Director of TVS Motor Company, and the award made in pursuance thereof shall be binding. The Cost and expenses of the Arbitration shall be equally shared by us and you. Subject to the arbitration provisions, you agree that the courts in Bangalore, India shall have an exclusive jurisdiction over such disputes.
9. Changes to This Policy
We may update this Privacy Policy from time to time. You are encouraged to check this Privacy Policy on a regular basis to be aware of the changes made to it.
